If you receive a damaged package, do not accept or sign for it. Please refuse the package so it will be returned to the distribution center. A new package will then be sent as a replacement.
Simformotion™ LLC (“Simformotion”) warrants the products listed below in accordance with the following:
The warranty period commences on the date the product is delivered to the original purchaser and continues for the period set forth below. Simformotion warrants that it will use commercially reasonable efforts to repair or replace, free of charge, (i) any product that fails to perform substantially in accordance with the specifications set forth in Simformotion’s accompanying documentation therefor during the warranty period, and (ii) any media that proves to be defective in material and workmanship during the warranty period. At Simformotion’s sole option, Simformotion may accept the return of any such product and refund the purchase price, or an equitable portion thereof, paid by the original purchaser.

This warranty is limited to the original purchaser, i.e. is not transferable to subsequent owners. SPECIFICALLY EXCLUDED FROM THIS WARRANTY ARE FAILURES CAUSED BY OR RELATED TO (A) THE ACTS OR OMISSIONS OF PERSONS OTHER THAN SIMFORMOTION, (B) MISUSE, THEFT, VANDALISM, FIRE, WATER, OR OTHER PERIL, (C) ANY ALTERATIONS OR MODIFICATIONS MADE TO THE PRODUCT OR ANY COMPONENT THEREOF MADE BY PERSONS OTHER THAN SIMFORMOTION, (D) USE OF THE PRODUCT OTHER THAN AS SPECIFIED BY SIMFORMOTION, (E) THE OPERATING SYSTEM, WEB BROWSER OR SYSTEM ENVIRONMENT, OR (E) ANY CODING OR SPECIFICATIONS CREATED OR PROVIDED BY THE PURCHASER.
The purchaser shall pay Simformotion’s standard hourly rate for services for any work performed pursuant to a warranty claim that is not covered by this limited warranty.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMFORMOTION DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SIMFORMOTION DOES NOT ASSUME ANY LIABILITY FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES OR COVER, OR LOSS OF DATA, PROFIT, REVENUE OR USE. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. ALSO TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY SETS OUT THE PURCHASER’S EXCLUSIVE REMEDIES WITH RESPECT TO THE PRODUCTS COVERED BY IT. NO ATTEMPT TO ALTER, MODIFY OR AMEND THIS WARRANTY SHALL BE EFFECTIVE UNLESS AUTHORIZED IN WRITING BY AN OFFICER OF SIMFORMOTION.
Some states do not allow limitations on how long implied warranties last, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
